These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Scrape the Spread LLC, a Virginia limited liability company ("Company," "Scrape the Spread," "we," "us," or "our"), governing your access to and use of the Scrape the Spread website, web-based platform, emails, push notifications, and related services (collectively, the "Service").
You accept these Terms by affirmatively selecting the acceptance control presented at registration and, for changes to these Terms thereafter, as described in Section 20. Purchasing a subscription requires your affirmative assent to the subscription terms and recurring charges disclosed before purchase. Continued use after notice of revised Terms constitutes acceptance only where lawful. Our Privacy Policy describes our handling of personal information and is incorporated by reference for that limited purpose.
If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization. If you lack that authority, you may use the Service only in your individual capacity.
Before purchase, we disclose the selected plan’s price, billing frequency, automatic renewal terms, and cancellation method. The plan description and recurring charge disclosures shown at checkout form part of these Terms. If a checkout disclosure expressly conflicts with these Terms regarding the selected plan, price, billing term, trial, or promotional period, the checkout disclosure controls for that transaction. You consent to receive agreements, disclosures, and notices electronically, subject to applicable law.
“Market Data” means spreads, moneylines, totals, odds/prices, scores, clocks, game status, and similar sports or wagering-market information. References to spreads include the corresponding point-spread markets in specific sports (such as run lines in baseball and puck lines in hockey); distinct market types are not otherwise interchangeable.
Scrape the Spread is a subscription-based sports data monitoring and alert platform. It monitors Market Data, including spread movements, and sends user-configured alerts through available channels, which may include email and push notifications. Depending on the plan and current product configuration, the Service may allow users to:
Scrape the Spread is not a sportsbook or gambling operator. We do not accept, transmit, place, or settle wagers; hold wagering funds; open or administer sportsbook accounts; determine bookmaker lines; guarantee access to any wagering market; or act as an agent, fiduciary, broker, financial adviser, or representative of any user or bookmaker.
Alerts are generated from user-selected criteria and third-party data. They are not individualized betting picks or instructions to place a specific wager. You remain solely responsible for deciding whether, when, where, and how to use any information from the Service.
Changes to the Service. We may add, modify, suspend, limit, or discontinue features to maintain, secure, improve, or comply with legal or third-party requirements applicable to the Service. We will not materially reduce the core features of a paid plan during a prepaid term without providing reasonable advance notice and, where required by law, an opportunity to cancel or a prorated refund for the materially affected unused portion. Changes that add features, address security or legal requirements, or do not materially reduce a paid plan may take effect immediately.
You must be at least 21 years old, have the legal capacity to enter a binding agreement, and meet any higher minimum age applicable to your intended use of sports-wagering information. By using the Service, you represent and warrant that you satisfy these requirements.
The Service is offered only for use in the United States. You may not access or use the Service where doing so is prohibited, or use it in connection with wagering that is unlawful in your location. Availability of the Service does not mean that sports wagering is lawful in your jurisdiction.
You may not use the Service to facilitate wagering if you are self-excluded, barred, suspended, or otherwise ineligible to wager; to unlawfully or without authorization place, arrange, or coordinate wagers for another person; or to evade any age, identity, geolocation, responsible-gambling, account, or other restriction imposed by law or a bookmaker.
We do not routinely verify age, identity, account ownership, location, or wagering behavior, and we do not monitor your betting activity. We may restrict, suspend, or terminate access when we reasonably believe there is fraud, a security issue, unlawful use, ineligibility, or a breach of these Terms. These rights do not impose a duty to monitor users or their wagering behavior.
To access subscription features, you must create an account and provide accurate, current, and complete information, including your name and email address. You also create a password for account access. Payment information is submitted through the payment interface hosted on Stripe’s site. We do not request your age or date of birth as part of account registration. You must promptly update the information you provide and may not provide false or misleading information.
You are responsible for maintaining the confidentiality of your credentials, using reasonable security precautions, and promptly notifying us at support@scrapethespread.com of suspected unauthorized access. You are responsible for activity you authorize or that results from your failure to use reasonable account-security measures, except to the extent applicable law provides otherwise.
Accounts and subscriptions are personal to the registered user unless an applicable business plan expressly states otherwise. You may not share, sell, transfer, rent, or sublicense an account; use another person's account; create multiple accounts to evade plan limits or enforcement; or use an account to unlawfully or without authorization place, arrange, or coordinate wagers for another person.
We may require credential resets, suspend access, or terminate an account when we reasonably believe it is compromised, fraudulent, abusive, unlawful, used in breach of these Terms, or poses a risk to users, third parties, providers, or the Service. Section 17 explains termination and refund consequences.
The Service currently offers monthly subscriptions. The available plans, prices, and feature limits are displayed on our pricing and signup pages and in your account’s Billing page. Before purchase, checkout discloses the price, monthly billing frequency, automatic renewal, and cancellation method for your selected subscription, and those disclosures are incorporated into these Terms. Unless expressly stated otherwise at checkout, subscriptions are for one user and begin when payment is accepted. Any future trial or promotion is subject to the disclosures described in Section 6.
Plan upgrades and downgrades. While your subscription is active and in good standing, you may upgrade or downgrade your plan by selecting a different plan on your account’s Billing page. An upgrade takes effect immediately, and you will be charged at that time a prorated amount for the difference between the two plans’ prices for the remainder of your then-current billing period. A downgrade takes effect at the start of your next billing period, and you keep your current plan’s features until then. When a downgrade takes effect, the lower plan’s features and limits apply, and Scrapes or settings that exceed them may be paused or disabled. After either change, your subscription automatically renews each month at the then-current price of your new plan, as described in Section 6, until you cancel.
Fees are stated in U.S. dollars and are exclusive of taxes that we are required to collect. Payments are handled by Stripe through a payment interface hosted on Stripe’s site. By submitting payment information, you represent that you are authorized to use the payment method and authorize us and the processor to charge all disclosed subscription fees, renewal charges, taxes, and other authorized amounts. We do not guarantee the security or uninterrupted availability of any third-party processor.
If a payment fails, we or our processor may retry the charge, request updated payment information, use permitted account-updater services, and suspend paid features after any disclosed grace period. You remain responsible for amounts incurred before cancellation. You must notify us promptly of a suspected billing error and cooperate in reasonable verification of the charge.
Except where required by law, expressly stated at checkout, or provided under Sections 2 or 17 (including the existing service-change and Company-termination provisions), subscription fees are nonrefundable and cancellation does not create a prorated refund or credit. Nothing in these Terms limits a nonwaivable right to a refund or remedy.
We may change prices for a future renewal term by providing advance notice of the change and how to cancel, within the notice period required by applicable law. A price increase will not take effect before the applicable notice requirements have been satisfied or during a term already paid for. You may cancel renewal before the new price applies.
IMPORTANT AUTOMATIC-RENEWAL DISCLOSURE: Your monthly subscription will automatically renew each month at the then-current price, plus applicable taxes, unless you cancel before renewal. Before purchase, we disclose the price, monthly billing frequency, automatic renewal terms, and cancellation method and obtain your affirmative consent to the subscription and recurring charges. By subscribing with that consent, you authorize Scrape the Spread LLC and Stripe to charge the disclosed recurring amounts until you cancel. The post-purchase email confirmation described below contains these terms and instructions you can save or print.
You may cancel automatic renewal online at any time by selecting “Cancel Subscription” from the Billing page on your account (which is also reachable from your Account Settings page) and confirming cancellation on that page. You may also cancel automatic renewal online at any time through our payment processor’s billing portal. Cancellation stops the next renewal when submitted; access continues through the end of the current paid term unless the account is suspended or terminated for cause. We will provide a cancellation method at least as easy to use as the method used to subscribe, without requiring interaction with a live or virtual representative when the subscription was initiated online. If we also offer cancellation by email, a cancellation request through that offered channel is effective when received, without a several-day advance-notice requirement. We do not charge a cancellation fee.
If we offer a free trial, discounted introductory period, or other free-to-paid conversion, the price and timing of the first paid charge, renewal terms, and cancellation deadline will be disclosed before enrollment and in the confirmation. We will send renewal, trial-ending, price-change, and other notices when required by applicable law.
After enrollment, we will send an automated email confirmation that you can save or print. It will include the selected plan, price and recurring charges, billing frequency and renewal terms, cancellation policy, and instructions for canceling online.
By creating an account, you consent to receive transactional and service communications reasonably necessary to provide the Service, including account, security, billing, renewal, cancellation, and alert-related emails and push notifications. These communications are not marketing merely because they reference your subscription or account.
Marketing communications are optional where required by law. You may unsubscribe from marketing email using the link in the message. Doing so will not stop account, security, billing, renewal, cancellation, legal, or alert-related communications. You can turn off alert emails using the unsubscribe link in any alert email, and you can manage email and push alert settings in Account Settings and in each Scrape’s settings. Push notifications can also be turned off in your browser or device settings; push permission is set separately on each device. Disabling a channel may prevent delivery of alerts through that channel.
The Service does not include SMS messages, nor does the Service request or require your mobile phone number. If we decide to offer SMS notifications as part of the Service, we will first obtain any consent required by applicable law through a separate disclosure.
You are responsible for keeping your email address and device settings current, allowing appropriate sender domains or notifications, and reviewing your account. We do not guarantee delivery, receipt, timing, or a particular volume of alerts or other messages. Carrier, device, internet, spam-filter, and third-party delivery issues may delay or prevent any communication.
You may use the Service only for lawful, personal, noncommercial purposes and in accordance with these Terms. Without our prior written permission, you may not:
A violation may result in investigation, preservation of relevant records, restriction or immediate suspension, termination without refund for cause, and referral to a provider, bookmaker, regulator, integrity body, or law-enforcement authority where reasonably appropriate or legally required.
The Service, including its software, interfaces, design, text, alert logic, compilations, documentation, branding, and Company-created content, is owned by or licensed to the Company and is protected by intellectual property and other laws. Sports, bookmaker, league, team, provider, and other third-party data and marks remain the property of their respective owners.
Subject to these Terms and payment of applicable fees, we grant you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use the Service for your own lawful, noncommercial purposes during your active subscription and any limited access we provide after your active subscription ends. No ownership right is transferred, and all rights not expressly granted are reserved.
If you submit suggestions, corrections, feature requests, or other feedback, you grant the Company a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use and incorporate that feedback without restriction or compensation. Do not submit feedback you consider confidential or proprietary.
The Service depends on Market Data supplied or made available by third parties. We may add, remove, or change data sources and providers at any time. A provider may change its data, terms, availability, or access without notice, restrict access, or become unavailable.
The Service may identify or link to bookmakers, data providers, leagues, teams, applications, payment processors, or other third parties. Those services are governed by their own terms, privacy policies, house rules, eligibility requirements, and technical limitations. We do not control or assume responsibility for a third-party service, offer, content, security, availability, decision, or transaction.
Unless expressly stated, Scrape the Spread is not affiliated with, endorsed by, sponsored by, or acting on behalf of any bookmaker, league, team, media company, or data provider. Third-party names and marks are used only for identification and descriptive reference. We currently receive no compensation from third parties. If we receive compensation in the future for a link, referral, promotion, endorsement, or other material relationship, we will disclose that relationship clearly and conspicuously where required by law.
Data collection and alert processing occur at variable intervals determined by data-source availability, sport, market, plan, system load, and technical conditions. Any interval described in product materials is an estimate, not a service-level commitment. Third-party outages, rate limits, corrections, network latency, queueing, maintenance, and other factors may interrupt monitoring or delay, duplicate, suppress, or prevent an alert. We do not guarantee that the Service will identify every threshold event or send an alert within any particular time or at all.
No guarantee of data accuracy or timeliness. Odds, spreads, money lines, totals, scores, game clocks, game state, market status, and other data may be delayed, incomplete, inaccurate, unavailable, or inconsistent across sources. Data shown in an alert reflects information available to the Service when the alert was generated and may differ from information displayed by a bookmaker when you review or act on it. You must independently verify all material information directly with the applicable bookmaker before making any wagering or financial decision.
No guarantee of market availability. Receipt of an alert does not mean that a described spread, price, market, or wagering opportunity is or will remain available. Bookmakers may change or suspend markets, reject or limit wagers, limit or close accounts, change house rules, or restrict access at any time. Scrape the Spread does not control any bookmaker and is not responsible for those actions.
Different bookmakers may display materially different lines, odds, alternate spreads, prices, market names, settlement rules, and availability for the same event. An alert is based on the data source, bookmaker reference, market, tracked team, and other parameters identified when generated. A different value on a bookmaker platform is not, by itself, evidence that the Service malfunctioned.
Trigger behavior. A configured trigger under a Scrape fires at most once for each tracked team and trigger level in a game. A later return to or movement through the same level on that Scrape does not re-arm that trigger. Editing or replacing a trigger may not re-arm a level that already fired for the tracked team and game. A new Scrape, including one created to replace a deleted Scrape, has its own triggers.
Alert deduplication. If multiple Scrapes match the same game, tracked team, trigger level, point value, and bookmaker at substantially the same time, the Service may combine them into one notification. Deduplication is intended product behavior and does not create an entitlement to a separate credit for each matching Scrape.
Plan and feature limits. The number and type of active Single Scrapes, Full Scrapes, sports, bookmakers, filters, alerts, historical records, and other features available to you are those shown for your plan at checkout or in the then-current plan description. We may adjust nonmaterial operational limits and may change plan limits for future renewal terms as described in Sections 2, 5, and 20.
Alert volume. The number of alerts depends on the triggers, filters, sports, schedules, markets, and bookmakers you select. Broad filters and small thresholds may generate many notifications. For example, more than 100 games are contested on a typical busy college basketball Saturday. Depending on your settings, a single Full Scrape monitoring college basketball could track both teams in every one of those games. You are responsible for configuring your Scrapes and notification settings to produce a volume you consider appropriate.
Coverage limitations. Not all providers or bookmakers publish data for every sport, league, game, market, or time period. Less prominent events and live markets may have limited or no coverage. Intermittent or missing data for a particular event or bookmaker is not necessarily a failure of the Service.
Before acting on any alert, independently confirm the current spread, odds, score, clock, market status, eligibility, house rules, and other applicable wager terms or pricing (including money lines and totals, as applicable) directly with the applicable bookmaker. Except where required by law, an individual missed, delayed, duplicate, deduplicated, or inaccurate alert does not by itself entitle you to a refund or credit.
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. IT DOES NOT CONSTITUTE GAMBLING, FINANCIAL, INVESTMENT, TAX, LEGAL, OR OTHER PROFESSIONAL ADVICE; A PROMISE OF PROFIT; A GUARANTEE THAT A WAGER IS AVAILABLE OR WILL WIN; OR A RECOMMENDATION SUITABLE FOR YOUR FINANCES, OBJECTIVES, RISK TOLERANCE, OR CIRCUMSTANCES.
Wagering involves risk of losing some or all amounts staked. You are solely responsible for your decisions, wager size, bankroll management, verification of information, compliance with law and bookmaker rules, and all taxes, fees, losses, and consequences resulting from your wagering or use of the Service. Do not rely on the Service as the sole basis for a wagering decision.
Historical alerts, examples, backtests, win rates, trends, model outputs, or other performance statistics are not guarantees or reliable predictions of future results. Any such claim is subject to its accompanying methodology, assumptions, time period, sample, exclusions, pricing, and other disclosures.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA, ALERTS, CONTENT, LINKS, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE COMPANY AND ITS LICENSORS, PROVIDERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be accurate, complete, current, secure, uninterrupted, error-free, compatible with every device or provider, free from harmful components, or available in every location; that alerts will be sent, received, or useful; that a spread or market or any other Market Data will be available; that any data source or third party will continue to provide access; that use of the Service is lawful for every user or purpose; or that use of the Service will produce a profit or any particular result.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted, and nothing in these Terms excludes a warranty or consumer right that cannot lawfully be waived.
Scrape the Spread is a sports-data alert service, not a sportsbook or gambling operator. The Service may be used by eligible adults as one source of information concerning wagering markets, but it does not accept wagers, hold wagering funds, or control bookmaker decisions. We do not monitor your betting activity or determine whether wagering is appropriate for you.
Only wager if it is lawful, you are at least 21 or otherwise eligible, and you can afford to lose the full amount staked. Set limits, do not chase losses, do not use borrowed funds or money needed for essential expenses, and stop if wagering causes financial, emotional, work, or relationship harm. For confidential problem-gambling support, call or text the National Problem Gambling Helpline at 1-800-MY-RESET (1-800-697-3738) or use the state-specific resources available through the National Council on Problem Gambling.
Nothing in the Service guarantees the outcome of an event or wager. Past alert activity, historical results, backtests, and observed patterns do not guarantee future performance.
If you are self-excluded or believe the Service is contributing to harmful gambling, stop using it and seek assistance. You may cancel and request closure of your Scrape the Spread account or suppression of marketing communications by contacting us. Closing a Scrape the Spread account does not enroll you in, or replace, a sportsbook or state self-exclusion program.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS LICENSORS, DATA PROVIDERS, PAYMENT PROCESSORS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; COST OF SUBSTITUTE SERVICES; OR ANY WAGERING STAKE, LOST WINNINGS, LOST OPPORTUNITY, LINE MOVEMENT, MARKET SUSPENSION, REJECTED OR LIMITED WAGER, BOOKMAKER ACCOUNT LIMITATION OR CLOSURE, TAX, FEE, OR OTHER LOSS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE COMPANY AND ALL PERSONS OR ENTITIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE SUBSCRIPTION FEES YOU PAID TO THE COMPANY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
The exclusions and cap apply regardless of the theory of liability and even if a remedy fails of its essential purpose. They do not apply to liability that cannot be limited by law, including liability for the Company's fraud, willful misconduct, or gross negligence to the extent such liability is nonwaivable, or for personal injury caused by the Company where limitation is prohibited. In jurisdictions that restrict a limitation, liability is limited to the maximum lawful extent.
To the extent permitted by law, you will defend, indemnify, and hold harmless the Company and its affiliates, licensors, data providers, members, managers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable attorneys' fees arising out of or relating to: (a) your unlawful or unauthorized use of the Service; (b) your material breach of these Terms; (c) your violation of a third party's intellectual-property, privacy, publicity, contractual, or other rights; or (d) wagers or transactions placed or arranged through an account you control for another person.
We may control the defense and settlement of an indemnified claim. You will reasonably cooperate and may participate through counsel at your own expense. We will not settle a claim in a manner that admits your personal wrongdoing or imposes a nonmonetary obligation on you without your consent, which will not be unreasonably withheld.
You may cancel automatic renewal as described in Section 6. Submitted cancellation stops the next renewal; access continues through the paid term, subject to suspension or termination for cause. Cancellation does not by itself delete your account. You may request that your account be deleted through your Account Settings page or by contacting support@scrapethespread.com, subject to the Privacy Policy and applicable lawful retention exceptions.
We may suspend, restrict, or terminate the Service or an account immediately when reasonably necessary for payment failure, security, suspected fraud or abuse, legal or regulatory compliance, provider requirements, responsible-gambling concerns, ineligibility, unlawful use, or a material breach of these Terms. Termination for cause does not entitle you to a refund. If we terminate an active paid subscription for convenience and not for cause, we will provide a prorated refund for the unused portion of the prepaid term unless prohibited or impracticable due to circumstances beyond our reasonable control. This Section does not limit the service-change provisions of Section 2 or any nonwaivable refund right.
The following provisions survive expiration or termination: Sections 5 and 6 solely as to payment obligations accrued before termination and related billing, cancellation, and consent records; Section 8 as to restrictions on retained copies and unauthorized use; Section 9 as to ownership, license restrictions, reserved rights, and feedback rights; Sections 10 through 13 as to third-party limitations, informational-use limitations, and disclaimers; Section 15 (limitations of liability); Section 16 (indemnification); Section 18 (dispute resolution); Section 19 (retention and privacy); and Sections 21 and 22 (general terms and notices). The access license in Section 9 ends with the applicable subscription or earlier termination and does not survive.
Governing law. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below. Subject to that Act and any nonwaivable consumer protections of your home jurisdiction, Virginia law governs these Terms without regard to conflict-of-law rules.
Please read this Section carefully. It affects your right to go to court. Except for the limited exceptions below, you and the Company agree to resolve every dispute, claim, or controversy arising out of or relating to the Service, these Terms, marketing, subscriptions, payments, data, communications, or your relationship with the Company through binding individual arbitration.
NOTICE OF INDIVIDUAL ARBITRATION AND CLASS-ACTION WAIVER. Except for the limited exceptions described in this Section, you and Scrape the Spread LLC agree that disputes will be resolved by binding individual arbitration, not by a judge or jury. You and the Company waive the right to a jury trial and to participate in a class, collective, consolidated, representative, or private-attorney-general action. You may opt out of arbitration by following the procedure below within 30 days after first accepting these Terms.
Informal resolution required first. Before commencing arbitration or any court proceeding, the claimant must provide the Company with an individualized written notice of dispute. The notice must include the claimant’s full name, account email address, a reasonably detailed description of the facts giving rise to the dispute, the specific relief requested, and, if monetary relief is sought, the amount requested and a reasonable explanation of how that amount was calculated. Each claimant must submit a separate notice. Notices to the Company must be sent to support@scrapethespread.com with the subject “LEGAL NOTICE.” The 30-day informal-resolution period begins when the Company receives a substantially complete notice. During that period, the parties will attempt in good faith to resolve the dispute. Neither party may commence arbitration or litigation until the 30-day period expires, except where immediate relief is necessary and permitted under this Section. Any applicable limitations period will be tolled during the 30-day period to the extent permitted by law.
Arbitration administrator and rules. If the dispute is not resolved, either party may commence arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by these Terms. The arbitration agreement must be interpreted consistently with the AAA Consumer Due Process Protocol. If AAA is unavailable and the parties cannot agree on a substitute, a court of competent jurisdiction will select one. The Company will pay arbitration fees it is required to pay under the applicable rules or law; fee shifting is permitted only as authorized by law or the arbitrator under those rules.
Procedure and location. The arbitration may be conducted by documents, telephone, video, or an in-person hearing in Washington, DC, or another mutually agreed location. The arbitrator may award the same individual remedies a court could award, but only to the individual claimant and only to the extent necessary to resolve that claimant's claim. Judgment on the award may be entered in any court with jurisdiction.
Arbitration opt-out. You may opt out of the arbitration agreement by emailing support@scrapethespread.com within 30 days after you first accept these Terms. Use the subject “LEGAL NOTICE” and include your full name, account email address, and a clear statement that you are opting out of arbitration. Your notice is timely if sent within that 30-day period. Opting out will not affect your access to the Service or the other provisions of these Terms. If you timely opt out, neither you nor the Company is bound by the arbitration agreement; the provisions governing matters properly proceeding in court remain applicable.
Exceptions. Either party may bring an individual claim in small-claims court if it remains within that court's jurisdiction. Either party may seek temporary or preliminary relief in court to protect intellectual-property or confidential-information rights pending arbitration. You may submit a complaint to a government agency. A claim for public injunctive relief may proceed in court to the extent applicable law makes that right nonwaivable.
Individual proceedings only. You and the Company waive any right to have a dispute heard or resolved as a class, collective, consolidated, representative, mass, coordinated, or private-attorney-general action, except that 25 or more substantially similar arbitration demands filed or coordinated by the same or related counsel will be administered under the AAA Mass Arbitration Supplementary Rules, including appointment of a process arbitrator where applicable. The arbitrator may not consolidate claims or award relief to anyone other than the individual claimant unless all affected parties agree in writing.
Jury trial waiver and exclusive court venue. To the fullest extent permitted by law, you and the Company knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or dispute that is not subject to arbitration under this Section. Unless applicable nonwaivable law requires otherwise, any such action or proceeding must be brought exclusively in the state or federal courts serving Fairfax County, Virginia, and each party irrevocably submits to the personal jurisdiction and venue of those courts. This provision does not alter any right to bring an eligible individual claim in small-claims court or any other right that applicable law expressly prohibits the parties from waiving.
Severability and changes. If the class action waiver is held unenforceable as to a particular claim or request for relief, that claim or relief will proceed in court after all arbitrable matters are completed. Other invalid provisions will be severed or narrowed while preserving the remainder. A material change to this Section will apply prospectively only; we will provide advance notice and a method to reject the change without terminating your then-current subscription. This Section does not change the rules governing a dispute for which either party received a written legal notice before the change became effective.
Our Privacy Policy describes our handling of personal information, including retention and deletion. Cancellation of renewal and account deletion are separate actions. We may retain information as reasonably necessary to provide the Service, maintain security, prevent fraud, satisfy legal obligations, maintain tax and accounting records, enforce these Terms, and establish, exercise, or defend legal claims, subject to applicable law.
Canceled and inactive accounts. If you cancel without requesting account deletion, we may retain the account and configurations to allow reactivation, preserve user preferences, prevent abuse, and meet legal or business needs. Monitoring and alerts stop when the paid term ends unless you reactivate.
Inactive-account deletion. We may delete or deidentify inactive accounts after providing any notice required by applicable law. The absence of a deletion notice does not create a promise to retain an inactive account or its data indefinitely. Accounts that have been created but whose registered email address has never been verified are subject to deletion at any time without notice.
Past-due accounts. If payment fails, we may suspend monitoring after any disclosed grace period while retaining account and billing information for collection, reactivation, security, and legal purposes. Successful payment may restore access, subject to plan availability.
Account deletion is subject to applicable legal obligations and exceptions. It does not necessarily remove information immediately from every retained record, including backups, which are deleted on a rolling basis. Any retained personal information remains subject to the Privacy Policy and applicable law.
We may revise these Terms to reflect changes in the Service, law, security practices, business operations, providers, or risk allocation. We will provide at least 30 days’ advance notice of a material change by email, in-product notice, or another legally permitted method, unless a shorter period is reasonably necessary to address legal requirements, fraud, abuse, security, provider action, or imminent harm. We will obtain affirmative acceptance when required by law or when we determine a change should not be based solely on continued use.
A material change will not retroactively alter the rules governing a dispute for which either party already received a written legal notice. If you do not agree to revised Terms, you must cancel before they take effect and stop using the Service. Continued use after the effective date constitutes acceptance only where applicable law permits. Changes to price, plan features, and arbitration are also subject to Sections 2, 5, 6, and 18.
Entire agreement and order of precedence. These Terms, the Privacy Policy, and the checkout disclosures for your subscription are the entire agreement concerning the Service and supersede prior or contemporaneous discussions on that subject. A specific checkout term controls over a conflicting general term only for the applicable plan, price, billing period, trial, or promotion; these Terms otherwise control.
Assignment. You may not assign or transfer these Terms or an account without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service, provided the assignee assumes the applicable obligations.
Severability; waiver. Except as specifically provided in Section 18, if a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. A failure to enforce a provision is not a waiver. A waiver must be in writing and applies only to the stated instance.
No agency; third-party beneficiaries. These Terms do not create a partnership, joint venture, employment, fiduciary, franchise, or agency relationship. Except for Company affiliates and indemnified parties other than licensors, data providers, payment processors, and other service providers, solely as to provisions expressly benefiting them, there are no third-party beneficiaries. A licensor or provider does not acquire third-party-beneficiary rights merely because it also falls within another category of indemnified parties.
Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, including provider or network outages or service delays, denial-of-service attacks, labor disputes, natural disasters, public-health events, war, civil unrest, government action, changes in law, market closures, or failures of sports, media, bookmaker, communications, cloud, payment, or data systems.
Headings and interpretation. Headings are for convenience only. "Including" means "including without limitation." Electronic records and signatures satisfy writing and signature requirements to the extent permitted by law.
For customer support, subscription questions, account deletion requests, and legal notices, contact us using the information below.
